Every drunk driving trial, especially ones involving a serious alcohol-related crash that resulted in a serious person injury, should be taken seriously.  Many of these cases will even make the news as a part of a brief public safety story.  However, when a state trooper is arrested for drunk driving following a serious crash, the case can take on a different shape and can become much more newsworthy to the general public.   However, it should be noted that every drunk driving crash is of the highest importance to the victims and their families.

gavel4A recent news article from the Eagle-Tribune involves a drunk driving accident in which the accused is a Massachusetts State Trooper.  This trooper was off-duty at the time of the alleged drunk driving accident, which occurred in Salem, Massachusetts, and it occurred in 2014.  Since this case is being tried as a felony in the Superior Court following an indictment, it is normal for some time to pass before trial, especially in a case such as this, where the trial judge just recused himself to prevent anyone from believing he is deciding on issues in a biased manner. As you drive through the City of Boston and other large metropolises like New York and Washington, DC, you are likely to see picketers marching with large signs and chanting outside a large downtown office building.  These picketers have decided they are being oppressed or taken advantage of by their employer, and they need to speak out.  They are taking a big risk, because, depending on their level of skill as worker and the relative strength of the local union, they might end out losing their jobs.  At the very least, they are having to suffer the consequences of going without pay for a potentially substantial about of time.

barsignIn addition to the many economic threats, it seems there are other types of risks from spending hours alongside a crowded city street.  According to a recent news feature from the Boston Globe, a Verizon worker was picketing outside a wireless store location when an alleged drunk driver crashed into him so violently that he was flipped onto the car and then was thrown onto the roof of the vehicle. This occurred a few minutes before nine in the morning. Continue reading

This is the time of year when schools are holding their proms, and students are out on the roads more than they have been in past months.  Aside from the many new teens getting their drivers’ licenses, the days are longer, and the weather is nicer, so, in addition to the increase in the number of teens on the roads, we are seeing more drunk driving accidents, and many of these accidents result in serious injury or even death.

mWypFbU-300x224According to a recent news feature from CBS Local Boston, local police and firefighters held a drunk driving accident demonstration at Burlington High School.  This drunk driving crash demonstration took place at the school three days prior to prom night. Continue reading

Back in season two of American Idol, Clay Aiken, Ruben Studdard and Rick Smith were all part of the final eight contestants hoping to win the singing competition and reality show, back when the show was very popular.  While Smith did not win the contest that year, he did gain a great deal of fame and got started on his music career.rosemusic

There is no question that when a person drinks to the point of intoxication and gets behind the wheel of a motor vehicle, he or she is acting in a negligent manner.  This means that he or she is acting in a such a way that shows a disregard for the safety of others, and could cause foreseeable injury to persons or property.  That is the definition of negligence in a personal injury case (including car accident lawsuits) in the Commonwealth.drivefastsaab

In many cases, a person will exercise bad judgment when they drink and then get behind the wheel, and while they will be completely liable for any personal injury or death that results from this negligent action, it does not necessarily mean that the driver is alcoholic.  Sometimes people just make mistakes, and sometimes they have to pay for those mistakes. One of the big issues that has made its way to the United States Supreme Court is whether a driver can be charged with a crime for refusing to submit to an alcohol breath test when asked by police upon a showing of probable cause that the driver is under the influence of alcohol.

1316049_untitled-300x200Essentially, in some states such as the Commonwealth of Massachusetts, a driver has the right to decline a breath alcohol test (generically called a Breathalyzer), and this refusal cannot be used against the defendant in a court of law.  Continue reading

There are currently many companies working to develop a self-driving or driverless car these days.  Some companies like Tesla are working to create not only the self-driving software and hardware, but also the car itself.  Supposedly, they will soon be offering a free trial of a software package that allows their already existing fully electric cars to become a self-driving vehicle.

shot-glass-1032719-mOther companies such as Google are working to develop the self-driving systems and then want to license or sell their technology to car companies, since the company is not interested in designing the vehicles themselves.  Knowing the past track record of Google products, it is likely they will be successful.  Continue reading
