Drunk driving is a criminal offense, despite the fact many frequent drunk drivers do not think of it as a crime.  While many people would never even dream of stealing a candy bar from a local drug store or supermarket, they have no problem drinking to the point of intoxication and then getting behind the wheel of a car.  This action is not only criminal, but can and often does result in a serious personal injury or even death.

one car keyNot only do people not see it as a crime before they are caught, many people are willing to get behind the wheel and do it again after they have been arrested for drunk driving on at least one prior occasion. According to a recent news article from the Boston Globe, a drunk driving car crash just resulted in a man near Waltham, Massachusetts being arrested for operating a motor vehicle under the influence of intoxicating liquor or drugs (OUI) second offense.  As a result of this crash, defendant and another driver ended up in local hospitals. According to a recent news article from CBS Local Boston, a police officer from the East Bridgewater Police Department suffered severe personal injuries after he was hit by and alleged drunk driver while he was waiting at a red traffic signal.  The 24-year-old alleged drunk driver was placed under arrest and charged with operating a motor vehicle under the influence of alcohol (second or subsequent offense), reckless driving, tailgating (following too closely), and failure to stop at a red light.

traffic ticketAuthorities have said the accident occurred around 1 p.m. as the officer was stopped at a red light at the intersection on Route 18 in the East Bridgewater area.  As the officer was waiting for the red light to change, the defendant allegedly crashed his 2013 Volkswagen Golf into the rear of the officers fully marked police SUV. According to a recent news article from the Miami Herald, a United States Marine Corps (USMC) veteran spoke to the families of the three victims he admitted to killing in a drunk driving accident.  Prosecutors have said the accident occurred early on a Sunday morning just before the sun had come up.  There had been a minor traffic accident when some students at the local high school had collided with a car being driven by a 68-year-old woman.

prisonAnother man was driving with his eight-year-old son, and, when he saw the accident, he pulled over to see if he could offer any help.  At this point, defendant came driving down the road at speeds greater than 70-miles-per-hour and crashed into all three vehicles.  Three victims died in this horrific accident. For more than a decade, there has been a major heroin epidemic in Boston and across Massachusetts. This has not only been a major problem for society in general, but it I also a major problem in terms of drugged driving and drugged driving accidents. In addition to heroin, there has also been a major increase in drugged driving accidents involving prescription narcotics ranging from methadone to fentanyl.   It’s a common misconception that a prescription for one of these powerful drugs is a license to freely use them before driving.

drugs-defect-pills-300x226This is of course not true.  Alcohol is the perfect analogy.  Alcohol is legal for anyone 21 or older to consume, but everyone knows it is illegal to drink and drive.  They may still do so, but they can’t claim they were unaware of it being illegal. Continue reading

There have been some questions raised following the Minnesota Vikings very different reactions to two recent drunk driving arrests involving members of the team and their staff.  One of the incidents involved the arrest of a third-year player on the practice squad (Isame Faciane) and the other involved the arrest of the team’s valued defensive coordinator, George Edwards.

football-1199159Edwards was arrested and charged with three criminal offenses related to his alleged drunk driving incident. One of those charges was fourth-degree DWI, which is a more serious drunk driving offense in that jurisdiction.  He agreed to plead guilty to careless driving and was given an entirely probationary sentence for one year and ordered to pay a $1,000 fine.  He was also ordered to attend drug and alcohol education programs and go to a victim impact panel meeting.

Meanwhile, Faciane was fired for his offense.

With drunk driving and drunk driving accidents being such an epidemic in the United States and the rest of the world, scientists and law enforcement agencies are constantly looking for new ways and technology to help curb this epidemic.  While breath-testing equipment has come a long way, it is still mainly used to convict people for drunk driving after the arrest or accident and is not a preventative measure.

phoneThere are vehicle breath ignition interlock devices that will not allow a car to start without the driver blowing a clean sample, but there are various ways to defeat this technology.  We have even seen cases where repeat drunk drivers with ignition interlock devices will have their child illegally sit in the front seat, so he or she can blow into the device instead of the driver. In 2010, the market was being flooded with alcoholic beverages that were mixed with ingredients from popular energy drinks, such as taurine and caffeine.  It did not take long for people to realize the dangers of the beverages in terms of drunk driving and for the U.S. Food and Drug Administration (FDA) to warn of the dangers of these products, and they were soon largely taken off the market. This was after many reports of drunk driving among college students, alcohol poisoning and other serious issues.

red-bull-boat-359586-mHowever, according to a recent news article from ARS Technica, there is a now a real danger of people drinking non-alcoholic energy drinks causing more incidents of drunk driving and more drunk driving car accidents across the nation. This report came as a result of a six-year study that followed 1,000 college students.  Study managers concluded that the more energy drinks a subject consumed, the more likely it was for that person to drive a vehicle while under the influence of alcohol. According to a recent news article from the Providence Journal, a defendant has been sentenced to be committed in a Massachusetts Correctional Institute (MCI) for no less than five years and no more than eight years after a fatal drunk driving accident on Interstate 195 that occurred last year.  Defendant, who is 63-years-old, pleaded guilty to a charge of manslaughter while operating under the influence of intoxicating liquor (OUI).

prisonThis charge is also called vehicular homicide.  Prosecutors said at defendant’s sentencing and plea hearing that he was driving at an excessive rate of speed when he crashed into the rear end of a Toyota.  After being hit from behind, the Toyota rolled completely over. The Toyota was being driven by a 73-year-old woman, who was also from Massachusetts.  As a result of this fatal drunk driving crash, she was thrown from her vehicle and died as a result of her injuries. First responders did what they could to save her and stabilize her on the scene before transporting her to a local level-one trauma center, but she was pronounced dead soon after arriving at the hospital. Over the past decade, more and more states have been moving toward the legalization of marijuana. In many cases, we are talking about medical marijuana, but in some states were are talking a complete legalization of marijuana for recreational purposes.  Colorado and Washington have led the nation in this effort, and other states are following in their footsteps. As of this year, around half of the states and the District of Columbia have legalized either medical marijuana, recreational marijuana use, or both.

some-dutch-green-1369327-mMassachusetts voters will have the chance to vote on Question 4 on the ballot, which, if passed would legalize marijuana for recreational use for adults who are 21 or older.  While many are in support of this legalization initiative, as a recent article from the MetroWest Daily News reports, law enforcement groups in the Commonwealth are united in their opposition to this ballot initiative, and they are getting support from law enforcement officials in Colorado and other states that have already legalized marijuana for recreational use. J. Geils, founder of the famous J. Geils Band that began in Massachusetts, was recently charged with operating a motor vehicle under the influence of alcohol (OUI), and he was cited for failing to stop at a stop sign in Concord, Massachusetts, according to a recent news report from the Lowell Sun.

timos-guitar-1477570John Warren Geils, Jr., who is better known as J. Geils, founded his band over three decades ago and also served as the band’s lead guitarist. The band is best known for their 80s hit song, “Centerfold” and “Freeze Frame” off the album also named “Freeze Frame.”  As for the facts surrounding his arrest, a Concord police spokesperson has said Geils was driving his vehicle in Concord when he was involved in a motor vehicle accident.
