The Massachusetts State Senate passed new legislation earlier this summer that will require alcohol ignition interlock devices in many operating under the influence (OUI) of alcohol or drugs cases.  An alcohol vehicle breath ignition interlock is a device that is installed on a car and will not let the driver start the vehicle until he or she blows into a sample tube and the car determines the driver is not under the influence of alcohol.

one-car-key-1149771-mWhile this is big step forward, the technology still has a long way to go.  Originally, drunk drivers would get someone who was sober to blow in the tube, and they would drive away.  This was known as a “blow and go” and would work until the car was turned off.  To combat this, the newer devices require a new sample to be given at random times throughout the drive when the car is not in motion. According to a recent news article from Fox 25 News Boston, a woman was recently arrested for drunk driving with not pants.  Authorities have said they noticed a car was driving in an erratic manner and initiated a traffic stop.

driving9The first thing the officer noticed was the woman was allegedly not wearing any pants or underwear.  This was all captured on the cruiser’s dash cam, which was operating at the time of her arrest.  After she noticed she was not wearing any pants, she asked her if she had been drinking any alcoholic beverages that night.  Her alleged response was that she had been drinking too much, and she should take her to jail already.  He asked her to put her pants back on, which she happened to have with her in the car. There are many people who drink until the point where they are intoxicated and then get behind the wheel of motor vehicle.  They do it all the time, night after night, and hope they won’t get caught or get into an accident.  The primary fear however, is getting caught, not getting into an accident, for most people.

mq2DQE8There are two ways we know this. The first is that most of the anti-drunk driving commercials have slogans like, “Drive hammered, get nailed,” or “Sober or slammer.”  These are not randomly chosen slogans, or simply picked because they rhyme.  There are extensive focus groups and psychological data that shows what prospective drivers fear in terms of drunk driving. According to a recent news feature from Yahoo Sports, Texas Rangers relief pitcher, Jeremy Jeffress, was arrested for drunk driving last Friday, and authorities have said he allegedly urinated on himself during the incident.

dJCgskAuthorities say the arrest occurred around two in the morning in the Uptown neighborhood of the city.   The police initiated the stop after he allegedly changed lanes without using a turn signal and nearly hit a police cruiser. When officers approached his car and looked inside, they allege that they immediately detected the odor of an alcoholic beverage and that his eyes were bloodshot, glassy, and watery.  He allegedly told officers that he had three or four drinks of Hennessey and coke. According to a recent news feature from Fox News, a man was celebrating his 34th birthday with a group of friends at a local hotel where the group was having a party.  San Diego Police say that the party-goers had been drinking that evening.

thirstyAt some point in the night, a female friend of the man decided she wanted to leave the party and would be driving her car home.  For reasons that are not made clear in the police account, the man decided he did not want her to leave the party.  It is not known if he was concerned about her possibly driving her car while drunk or whether he wanted her to stay for other reasons. When we think of traffic violations involving traffic lights, we typically think of running a red light.  However, according to a recent news feature from the La Crosse Tribune, a man was ultimately arrested and charged with a felony after a law enforcement officer witnessed him stopped at green traffic signal instead of driving through, as one is supposed to do.

green-light-texture-1187390You might be wondering why a police officer or sheriff’s deputy would have valid probable cause to pull someone over for stopping at green light.  The reason for this is because waiting at green light for an unreasonable amount of time is one of the many clues that a driver may be operating his or her motor vehicle under the influence of intoxicating liquor or drugs. These clues were developed, or more properly observed, by the National Highway Traffic Safety Administration (NHTSA) after decades of roadside observations. Continue reading

In the past couple of months, we have seen far too many incidents of people being arrested after being involved in an accident in a work zone in the Greater Boston area and throughout the Massachusetts.  While even a single drunk driving accident is one too many, we have seen around half a dozen drunk driving accidents in Boston and Revere, and state officials are trying to do whatever they can to stop this. We have already seen increased safety patrols by Revere Police, Chelsea Police, Boston Police and the Massachusetts State Police (MSP).

roadconstruction2Now, according to a recent news article from the Boston Globe, the state has just launched a new campaign to make it safer for highway workers and curb this recent blight of drunk driving incidents in the Commonwealth. The recent effort is said to be a “two-pronged” campaign.  The campaign will focus on educating the public about the dangers of drunk driving and increasing drunk driving patrols in work zones.  Both of these prongs are designed to save lives and keep workers and others on our streets and sidewalks safe from drunk drivers. According to a recent news feature from Medical Daily, a new study published in the Lancet Gastroenterology & Hepatology, alcohol consumption is reducing worldwide, and this may be a result of newer low alcoholic beers now popular on the market.

Our hope is that if people are drinking less, there will be less drunk driving incidents, which in turn will result in less drunk driving accidents and fewer alcohol-related fatalities.

beergardenThe data was derived from a Canadian organization that studies addiction and mental health. Their claim was that drinking beer with lower ethanol content would mean that people will have a lower blood alcohol content (BAC) in their respective blood streams, and this will result in less drunk driving accidents. Judges often say during sentencing that drunk driving is not like a lot of other crimes.  The reason for this is because it is a serious crime that can, and often does, result in the death of innocent victims that is often not taken seriously and often committed by a person who is otherwise not a typical criminal.  Not only that, it is one of the few crimes that a person who otherwise has no issues in their life will commit multiple times, even though it is costing them everything they have worked for.

mf1GjqGThere are a variety of reasons for this.  In many cases, especially with younger people, it is often seen as not a big deal, and something that everyone does.  In some cases, a drunk driver is someone who makes bad decisions, but not necessarily someone who made a bad choice, and was negligent, but is not what we would typically describe as an alcoholic.  However, in other cases, the drunk driver is an alcoholic and drives drunk on a regular basis, despite the tremendous risk to themselves and others.
